Pt 2 - The Family Court of Australia

This episode is on the Family Court of Australia, which is known as the FCFCOA, after merging with the Federal Court in 2021 (forming the Federal Circuit and Family Court of Australia). I also give a brief history lesson on the foundations of English common law in Australia and when matrimonial legislation was first introduced to provide rules, regulations, and protection for family and children. Before getting to Family Court, several mandatory, arduous tasks known as Pre-Action Procedures need to be completed first. Some of these are: * Family Dispute Resolution (FDR - can be done by telephone or video conference) * Obtain a Section 60I (S60I) Certificate * File a Notice of Intention to Commence Proceedings * File a Genuine Steps Certificate Depending on your situation, you may also be required to complete a number of court ordered directions, such as; counselling, parenting courses, a family report, or psychiatric evaluations etc. For further information or assistance, the attached links might be useful; Legal resources of the new Court: Rules, Practice Directions and forms | Federal Circuit and Family Court of Australia [https://www.fcfcoa.gov.au/news-and-media-centre/latest-news/legal-resources] Federal Register of Legislation - Family Law Act 1975 [https://www.legislation.gov.au/C2004A00275/latest/text] Structural reform of the federal courts | Attorney-General's Department [https://www.ag.gov.au/legal-system/courts/structural-reform-federal-courts#benefits-of-the-reforms] Botany Bay, New South Wales | National Museum of Australia [https://www.nma.gov.au/learn/encounters-education/community-stories/botany-bay#:~:text=On%2029%20April%201770%2C%20HMB%20Endeavour%20sailed%20into,were%20met%20by%20two%20Gweagal%20men%20with%20spears.] Kamay – Botany Bay | National Museum of Australia [https://www.nma.gov.au/exhibitions/endeavour-voyage/kamay-botany-bay] A place of encounters; a short history of Botany Bay National Park (Kurnell section) [https://www.environment.nsw.gov.au/resources/parks/KamayKurnellShortHistory.pdf] Federal Register of Legislation - Family Law Amendment (Information Sharing) Act 2023 [https://www.legislation.gov.au/C2023A00088/latest/text] THE FIRST HIGH COURT - Australian Constitution Centre [https://www.australianconstitutioncentre.org.au/the-first-high-court/] Establishment of the Family Court of Australia and its early years: A personal perspective | Australian Institute of Family Studies [https://aifs.gov.au/research/family-matters/no-60/establishment-family-court-australia-and-its-early-years-personal] Divorce records guide [https://mhnsw.au/guides/divorce-records-guide/] 11 Mar 1873 - MATRIMONIAL CAUSES ACT. - Trove [https://trove.nla.gov.au/newspaper/article/63228140] 08 Jun 1860 - THE DIVORCE BILL. - Trove [https://trove.nla.gov.au/newspaper/article/5683943] 08 May 1860 - THE DIVORCE LAW. - Trove [https://trove.nla.gov.au/newspaper/article/154844092] You searched for australian family court | History Cooperative [https://historycooperative.org/?s=australian+family+court] Article - Publications - Australian Institute of Family Studies (AIFS) [https://aifs.gov.au/sites/default/files/at_0.pdf] History of child protection legislation. | Find and Connect [https://www.findandconnect.gov.au/pubresource/history-of-child-protection-legislation/] Media Release: The new Federal Circuit and Family Court of Australia officially commences | Federal Circuit and Family Court of Australia [https://www.fcfcoa.gov.au/news-and-media-centre/media-releases/mr010921] Dire Federal Circuit Court backlogs prove family court merger a risk to families, judges - Law Council of Australia [https://lawcouncil.au/media/media-releases/dire-federal-circuit-court-backlogs-prove-family-court-merger-a-risk-to-families-judges]

Episode Pt 1 - Intro Cover

Pt 1 - Intro

I'm a 40-year-old father trying to understand and come to terms with how and why the Family Court of Australia, and some of the legal professionals who work in it, decided that I can no longer be in my 12-year-old son's life. I was unrepresented during our Court proceedings and was forced to represent myself. I have always been present in my son's life since he was born and have always tried my hardest to grow our relationship. I have other kids and have proven to be an excellent father. The Court-appointed psychiatrist who did our psychiatric evaluations even wrote in her report that I was a capable, independent father who had no personality problems or traumas that would affect my ability to parent. The same couldn't be reported about my ex-partner, who returned 4 negative personality traits. My son and I have been victimised by parental alienation over the years, and unfortunately, 2 of his mother's markedly high negative personality traits are often prevalent in parents who are pathological liars and parental alienators.  I've done some things wrong, but I've never been a bad father or dangerous, violent person. To say that a parent will treat their child the way they treated a partner through a turbulent separation, is a complete and utter fallacy. The Court......... doesn't always get it right! . . Happy Birthday Dad 🎉🎈 I wish things were different. xo
