In this episode we sit down with special guest, Sabiha Tudesco, as we discuss how businesses are navigating the complexities of modern data management and regulatory compliance while providing practical tips for sustainable growth and innovation.  We recorded this interview in early January.  On Friday, January 24, 2025, the U.S. Court of Appeals for the Eleventh Circuit vacated the Federal Communications Commission's (FCC) One-to-One Consent Rule, which was set to take effect on January 27, 2025. This rule would have required consumers to provide separate consent for each individual seller before receiving telemarketing or advertising robocalls, and mandated that such calls be "logically and topically associated" with the interaction that prompted the consent. The court determined that the FCC exceeded its statutory authority under the Telephone Consumer Protection Act (TCPA) by imposing these additional consent restrictions, as they conflicted with the ordinary statutory meaning of "prior express consent.” Foley & Lardner LLP [https://www.foley.com/insights/publications/2025/01/federal-communications-commissions-one-one-consent-rule/?utm_source=chatgpt.com] - Earlier that same day, the FCC had issued an order postponing the effective date of the One-to-One Consent Rule by 12 months, or until the Eleventh Circuit issued a decision on the pending legal challenge, whichever came sooner. However, the court's ruling to vacate the rule rendered the postponement moot.
