Wither Stare Decisis? An Examination of Recent Controversial SCOTUS Decisions and Their Effect on the Rule of Law

Stare Decisis – the foundational legal principle of respect for matters already decided – is one of the cornerstones of “The Rule of Law.”  But in the 2022 Dobbs decision overruling Roe v. Wade and the more recent Loper Bright decision overruling Chevron, the Supreme Court of the United States (SCOTUS) has notably (and controversially) rejected stare decisis and overruled two of its long-standing precedents. Along with SCOTUS’s decision weighing into former President Donald Trump’s criminal prosecution, these decisions have serious implications for the rule of law in America. In this two-part episode, Doug Barr hosts SKO partner Adam Reeves for a clear-eyed, neutral examination of three recent controversial SCOTUS decisions:  Dobbs v. Jackson Women’s Health Organization, Loper Bright Enterprises v. Gina Raimondo, Secretary of Commerce, and Trump v. United States.  Doug and Adam discuss the legal and historical underpinnings of these decisions and their political context, and they speculate how these decisions might affect the “Rule of Law.”  Acknowledging the controversy surrounding these decisions, Doug and Adam, through their discussion, try to dispassionately explain the law behind these momentous decisions. Thoroughbred Racing Safety and Integrity: An Update on HISA, the Landmark 2020 Federal Law Creating and Enforcing Uniform Track Safety, Anti-Doping and Medication Regulations in the Sport of Kings

Lawyers at SKO were instrumental in drafting and helping key Kentucky politicians shepherd the Horseracing Integrity and Safety Act of 2020 to Congressional approval and into law. The Act created the Horseracing Integrity and Safety Authority (HISA), a uniquely-structured agency meant to bring uniformity to the tangled morass of often inconsistent, opaque and even contradictory states’ regulations of thoroughbred horseracing in America. HISA is responsible for developing and enforcing rules for race track safety and, even more importantly, anti-doping and equine mediation rules that apply uniformly nationwide.  The constitutionality of the Act has been challenged repeatedly but it has so far survived. Three years after its effective date, how effective has HISA been in accomplishing the goals of this transformative legislation? Doug Barr hosts John C.
