Did the Defendant have a legitimate expectation of privacy in the area searched? a. If yes, is that expectation of privacy one that society is prepared to recognize as reasonable? 4. In what ways can the Defendant show under the “Totality of the Circumstances” standard that he did indeed have a legitimate expectation of privacy in the area searched? 5.
