Federal courts can only hear cases they have statutory power to hear. * Federal Question (§1331): Case arises under the Constitution, federal law, or treaties. * Diversity (§1332): Parties from different states + amount in controversy > $75,000. * Complete Diversity: No plaintiff can share citizenship with any defendant. * Non-waivable: Can be raised anytime—if missing, the case is void. Part 2 – Personal Jurisdiction (PJ) PJ = the court’s power over the defendant. From roommates to married couples, the type of ownership determines what happens when someone dies, sells, or faces creditors. Part 1 – What Is Concurrent Ownership? * When multiple people hold rights to the same property simultaneously. * The law recognizes three main forms: Tenancy in Common, Joint Tenancy, and Tenancy by the Entirety. Part 2 – Tenancy in Common (TIC): * No right of survivorship → if one co-owner dies, their heirs inherit the share. * Shares can be unequal (e.g., 70/30). * Each tenant has the right to possess the whole property. * Default type of ownership if the deed doesn’t specify. * Partition is the escape hatch if co-tenants can’t agree. * Case examples: * Spiller v. Mackereth → a co-tenant in sole possession doesn’t owe rent to others unless there’s an ouster. * Esteves v. Here’s what we cover: * Part 1 – What Are Long-Arm Statutes? Part 2 – Eligibility Rules (28 U.S.C. §1441) * Only defendants can remove (never plaintiffs or third-party defendants). * Federal court must have original jurisdiction: – Diversity example: TX plaintiff v.
