Andy explains what an unenumerated constitutional right is, and how, according to the leaked draft of Justice Sam Alito's upcoming Supreme Court opinion, abortion is not one of those.  Steve acknowledges the essential truth of that; he points out that even liberal hero Ruth Bader Ginsburg admitted Roe was not on very stable ground constitutionally.  Still, he thinks that a lot of what Alito has written is wrong, gratuitous, and / or potentially dangerous.

Does Will Smith slapping Chris Rock onstage at the Oscars matter?  We argue that it does, very much so, and so does the American public's response to it.  And that response is all over the map. Ginni Thomas is a Trump supporter who believes the 2020 election was stolen.  That describes millions of Americans.  But millions of Americans don't happen to be married to a Supreme Court Justice and have a close, friendly relationship with Donald Trump's Chief of Staff.
