Terms and Conditions of use

1. INTRODUCTION

Hi and welcome to Podimo!

Please take time to read these terms and conditions of use for the Podimo Service (defined below) and any terms and policies that they reference (jointly “Podimo Terms”).

The Podimo Terms are a legally binding agreement between the consumer that makes the order (“You”) and the seller

and cover Your access to and use of the digital content service, related software applications and all the content and other associated material and features offered on the service by Podimo from time to time (jointly “Podimo Service”).

If you do not agree to the Podimo Terms, You may not use the Podimo Service. By accepting the Podimo Terms, You acknowledge that you have entered into an agreement with Podimo and represent and warrant that You meet the requirements of the Podimo Terms. You agree to follow Podimo’s reasonable instructions and requirements specified below in relation to Your use of the Podimo Service and its content.

2. STARTING YOUR PODIMO JOURNEY

2.1. Eligibility

The Podimo Service is provided to individuals for their personal, non-commercial use only. Companies, associations and other groups may not register for nor use the Podimo Service.

You acknowledge that the Podimo Service is only available to individuals who: (i) are at least 18 years old, or have reached the minimum age required to lawfully give consent to the processing of their personal data in their country of residence, (ii) have the power to enter into a binding agreement with Podimo, and are not barred from doing so under any applicable law, (iii) are a resident of a country in which the Podimo Service is available, and (iv) use the Podimo Service for personal, non-commercial use.

The Podimo Service is not directed at children, and children may only access Podimo through the account of a parent or guardian, and only under their supervision. Podimo does not knowingly collect personal data from individuals under the minimum age required to give consent. If Podimo becomes aware that personal data has been collected from such an individual, Podimo will delete such information.

Podimo may analyze Your use of the Podimo Service, including use of Your Podimo Account, to determine compliance with the Podimo Terms. If Podimo determines that You have violated the Podimo Terms, Podimo may limit or terminate Your use of the Podimo Service, including the access to Your account and Your use of the Podimo Service and/or take any other steps as permitted by the Podimo Terms.

If You permit anyone else in your household to use or access the Podimo Service and/or the content thereon using Your Podimo Account, You acknowledge that some content offered on the Podimo Service may not be suitable for children or for some listeners/viewers and therefore discretion is advised. You are responsible for any use of your account by your household, including compliance with the Podimo Terms.

2.2. Your Podimo Account

In order to use the Podimo Service, You will have to register for an account (“Podimo Account”) and provide certain information as requested in the applicable onboarding flow. However, in some cases, You may be able to access and use certain features of the Podimo Service as a guest, without creating a full Podimo Account, as further described in section 2.4. below. These Podimo Terms apply equally to guest access.

Some information might not be asked of You during the applicable onboarding flow, but Podimo may request additional information from You at a later date (for example, the date of birth of profile user) subject to Podimo’s Privacy Policy in section 6, for purposes such as verifying eligibility or providing certain features.

You represent and warrant that all information You provide to Podimo is accurate and correct, and that You will keep the information up to date. You agree not to share Your Podimo Account or password and that You are solely responsible for all activity that occurs on Your Podimo Account (including any unauthorized use).

You are responsible for maintaining the confidentiality and security of Your access credentials. If You believe there has been any unauthorized access or use of Your Podimo Account, You must notify Podimo immediately and change Your password as soon as possible. Podimo will not be responsible for any activities on Your Podimo Account unless it has been caused by Podimo’s negligence.

2.3. Content Access

You may access the Podimo Service (and the content thereon) only in the market(s) where Podimo offers the Podimo Service, from time to time (the “Market(s)”). Where permitted by Podimo and at Podimo’s sole discretion, You may be able to access the Podimo Service (and the content thereon) from other locations, though Podimo does not guarantee or commit to You that You will be able to gain such access from any geographic location other than the Market(s). For subscribers residing in the European Union or European Economic Area, access to content on the Podimo Service will be provided in accordance with the Regulation (EU) 2017/1128 on cross-border portability of online content services.

2.4. Guest Access

When You use the Podimo Service, You can access certain content, features, and functionality for free, without the need to create a full Podimo Account or sign up to a Subscription Plan (defined below), as the case may be. In some of our Markets, content may be made available to You as a guest user, subject to limited access experience or specific onboarding flow. Guest access is personal, limited and may be withdrawn by Podimo at any time, and You remain responsible for any activities carried out during such access. The availability of free or guest-accessible content may vary depending on Your Market, device, or the applicable Podimo Service offering.

2.5. Subscription Access

To access certain exclusive content, features, and functionality that are reserved for paying users, You must subscribe to a paid plan or tier (a “Subscription Plan”) available in Your Market and pay the applicable subscription fee. The availability of subscriber-exclusive content may vary depending on Your Market, device, or the applicable Podimo Service offering.

Different Subscription Plans, as the case may be, are subject to differences in pricing, duration, eligibility, conditions, restrictions, and device availability. You can visit Podimo’s Support Center for full details of such features.

2.6. Payment

You may purchase a Subscription Plan directly from Podimo using the payment options available in Your market from time to time, or through available third-parties, such as, for example, the Apple App Store and/or Google Play. When You purchase a Subscription Plan through a third-party, the terms and conditions of that third-party will apply in addition to these Podimo Terms, as further described in section 4.3. below.

The Podimo Service is delivered, and You will have access to the content, immediately after signup. Podimo is not responsible for fees or penalties charged to You by Your bank or credit card company in connection with processing Your payment. By subscribing to a Subscription Plan, You authorize Podimo or the applicable third-party to automatically charge Your payment method in accordance with the terms of the subscription You purchased.

Unless otherwise stated in these Podimo Terms or in any specific terms applicable to Your subscription, as the case may be, Your subscription to the Podimo Service includes enrollment into an ongoing/recurring monthly or annual payment plan. Payment will be charged to your chosen payment method at confirmation of purchase and at the start of every new subscription period, unless canceled - for cancellation see section 8 below.

If Your subscription to the Podimo Service was enabled without the requirement to provide Podimo with a payment method, Your subscription will not automatically renew at the end of the applicable subscription period. If payment cannot be processed, Podimo reserves the right to suspend or terminate Your access to the Service until a valid payment method is provided.

2.7. Trial

Podimo may offer trials to a Subscription Plan membership for a specified period without payment or at a reduced rate (a “Trial”). Podimo reserves the right to determine Your eligibility for a Trial and revoke or modify a Trial at any time without prior notice and with no liability to You to the extent permitted under applicable law.

For some Trials, You will be required to provide Your payment details to start the Trial. By providing such details You acknowledge that Podimo may automatically begin charging You for the applicable Subscription Plan on the first day following the end of the Trial on a recurring monthly basis or other interval (as applicable) provided that this was stated in the conditions for the Trial. If You don’t want this charge, You must cancel the applicable subscription before the end of the Trial - for cancellation see section 8 below.

2.8. Audiobook Reset

If your Subscription Plan includes a monthly allowance of audiobook listening hours, please note that the listening hours available reset on the 1st day of each calendar month regardless of subscription start date or unused balance.

2.9. General

You acknowledge that content made available on the Podimo Service is subject to frequent change and may vary based on Your geographical location. Podimo therefore does not guarantee that particular content will be available on the Podimo Service or at any given time however with respect of cross-border portability as described in section 2.3. above. Additionally, the availability of content may be restricted by applicable laws or the rights granted to Podimo by third-party content providers.

When You use the Podimo Service, either as a guest or as a subscriber to a Subscription Plan, You acknowledge and agree that the Podimo Service may include: (i) live content or special events that contain traditional commercial breaks, (ii) advertisement that are shown before, during or after the playback of content, (iii) limited promotional content within the user interface, such as information about or connected to the Podimo Service and content available on the Podimo Service (including links which enable You to purchase goods or services), (iv) information about products or services from Podimo, and (v) product placement contained within the content.

3. YOUR USE OF THE PODIMO SERVICE

3.1. Reserved rights

The Podimo Service and all intellectual property rights associated with it is the property of Podimo or Podimo’s licensors. Podimo expressly reserves its rights and interest in all materials, including but not limited to the content made available via and within the Podimo Service. Such content is owned by Podimo, its affiliates and/or other licensors, and is protected by applicable copyright, trademark law and/or other intellectual property laws and treaties.

Without limiting the foregoing, Podimo grants You a limited, non-exclusive, revocable, non-transferrable, non-sublicensable right to access and use the Podimo Service solely for Your personal and non-commercial entertainment and use subject to these Podimo Terms.

You acknowledge that except for the rights expressly granted to You in these Podimo Terms, Podimo grants no rights, title or interest to You in the Podimo Service or its content.

3.2. Streaming and downloading content

Content can be streamed via the Podimo Service using an active Internet connection on a compatible device. Certain software may require periodic updates. Your use of the Podimo Service may be affected by the performance of these elements. For compatibility / system requirements for use of the Podimo App and Service please see Podimo’s Support article. Content may also be available for temporary download for offline listening/viewing on certain compatible devices. If offline listening/viewing is permitted by your Subscription Plan, such information would have been made available to you during the applicable onboarding flow.

3.3. Restriction on your use of the content on the Podimo Service

You agree that You may not and You agree not to:

i. circumvent or disable any content protection system or digital rights management technology used in connection with the Podimo Service to control access to the content;

ii. copy the content (except to the extent as expressly permitted herein);

iii. rebroadcast, retransmit, redistribute, transfer or publicly broadcast/perform the content available on the Podimo Service;

iv. create derivative works of the content; or

v. allow third-parties to violate the Podimo Terms.

4. ABOUT THE PODIMO SERVICE

4.1. General

The Podimo Service is a digital content service that provides access to podcast and audiobook content (and therewith associated material) to individuals as set out in these Podimo Terms.

The Podimo Service is constantly evolving. Podimo reserves the right to enable new features and functionality at any time and You agree that Podimo may make available provisions and/or deploy the same (or similar) at any time in accordance with and subject to these Podimo Terms and/or any special terms as updated to You.

4.2. Content

You accept and agree that Podimo is not responsible for information in the content on the Podimo Service (e.g. podcasts and audiobooks), and reliance on such information is expressly at Your own risk. You understand and agree that the content You receive through the Podimo Service is intended for informational and entertainment purposes only. The content does not constitute legal, financial, professional, medical or healthcare advice or diagnosis.

Content tends to elicit varying reactions among different people. You may come across content on the Podimo Service that You find offensive, indecent, explicit or objectionable. Also, content types, genres, categories, and/or descriptions are provided as suggestions to help with navigation, and for informational purposes. Podimo does not guarantee that You will agree with them. You acknowledge these risks and Your responsibility for making Your own choices regarding what content You deem appropriate.

4.3. Third-Party Rights

You accept and agree that the Podimo Terms do not grant any rights to anyone except You and Podimo, and that the Podimo Terms shall in no event create any third-party beneficiary rights with the following exception.

If You access or use the Podimo Service via a software application that You have downloaded from the Apple Inc. (Apple) App Store or that runs on an iOS operating system (“Podimo iOS App”), You confirm that You have read, understood and agree to the following in relation to Apple.

  • The Podimo Terms are between You and Podimo only, and not with Apple.
  • Apple is not responsible for the Podimo Service and its content.
  • Apple has no obligation to provide any maintenance and support services with respect to the Podimo iOS app. If You have any maintenance or support questions in relation to the Podimo iOS app, please contact Podimo and not Apple.
  • The Podimo iOS app may only be accessed and used on a device owned or controlled by You and using Apple’s iOS operating system.
  • In the event of any failure of the Podimo iOS App to conform to any applicable warranty, You may notify Apple and Apple will refund any applicable purchase price for the application (if any) to You. Subject to the foregoing, and, to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Podimo iOS App.
  • Except as expressly set forth in these Podimo Terms, and to the maximum extent permitted by applicable law, Apple is not responsible for addressing any claims by You or any third-party relating to the possession or use of the Podimo iOS app.
  • In the event of any third-party claim that the Podimo iOS app or Your possession and use of the Podimo iOS App infringes any third-party’s intellectual property rights, Podimo, and not Apple will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
  • Apple and its subsidiaries are third-party beneficiaries of the Podimo Terms, and when You accept the Podimo Terms You accept and agree that Apple will have a right to enforce the Podimo Terms against You as a third-party beneficiary.
  • You warrant and represent that (i) You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and (ii) that You are not listed on any U.S. Government list of prohibited or restricted parties.

Similar to the aforementioned, when accessing a Podimo application through any other App Store than the Apple App Store, You accept and agree that Your use of the relevant Podimo application may be subject to the terms of service or the relevant app store terms.

4.4. Third-Party Services

The Podimo Service may integrate, be integrated into, or be provided in connection with third-party services (and such third-party’s devices and/or content). Podimo does not control those third-party services. You should read the terms of use, agreements and privacy policies of such third-parties.

4.5. Third-Party Links

The Podimo Service may contain links to third-party websites or services. These third-party services are not controlled by Podimo, and Podimo takes no responsibility for their content and separate third-party terms may govern Your use of these third-party services.

4.6. Podimo Community Guidelines

In certain Markets Podimo has enabled or may in the future enable community features in the Podimo App and as part of the Podimo Service, enabling You to e.g. comment, discuss and interact with Podcasters and other Podimo users. By using such Podimo community features You accept the Podimo Community Guidelines found here: Community Guidelines.

4.7. Recommender System Transparency

The Podimo Service uses recommender systems to help suggest and prioritise content that may be of interest to You. These recommendations are primarily based on Your listening history and preferences, as well as Podimo’s commercial considerations, including partnerships and content agreements. This means that the order and selection of recommended content You see in the Podimo Service may be influenced by such factors.

Podimo may adjust future recommendations based on Your interactions — for example, if You mark content as not interested/thumbs down, You may receive fewer recommendations similar to it.

5. CHANGES TO TERMS, SERVICE AND SUBSCRIPTION PLANS

5.1. Changes to the Podimo Terms

Podimo may occasionally make changes to these Terms for valid reasons, including but not limited to:

  • improvements or additions of features and functionalities to the Podimo Service;

  • implementing technological advancements or ensuring the technical security and operability of the Podimo Service;

  • adapting to changes in applicable laws, regulations, or regulatory guidance;

  • aligning with industry standards or best practices; and

  • addressing misuse, errors, or clarifications.

Podimo will notify You at least thirty (30) days in advance of any material changes before such changes take effect for You. Where required by law, Podimo will seek Your express consent.

If You do not wish to accept the material changes, You may reject them by cancelling Your subscription before the date the new Terms take effect. Continued use of the Podimo Service after the effective date will constitute Your acceptance of the updated Terms.

5.2 Changes to the Podimo Service

Podimo will make reasonable efforts to keep the Podimo Service operational and to provide You with an evolving and improving experience.

From time to time, Podimo may modify, discontinue, or replace parts of the Podimo Service (including features and functionalities) for valid reasons, such as:

  • improving or enhancing the user experience,

  • ensuring the security and operability of the Podimo Service,

  • implementing advancements in science and technology, or

  • complying with legal or regulatory obligations.

Where such modifications or discontinuations result in material changes to the Podimo Service, Podimo will provide reasonable prior notice before the change takes effect.

If You have prepaid fees for a Subscription and the Podimo Service is permanently discontinued before the end of the prepaid period, Podimo will refund the prepaid fees corresponding to the unused portion of that period.

5.3. Changes to Subscription Plans and Prices

Podimo may offer the Podimo Service in different ways and with different Subscription Plans across Markets. Podimo reserves the right to adjust or modify the structure, features, or pricing of Subscription Plans, including recurring fees or pre-paid periods, where justified by valid reasons, such as:

  • changes in production, licensing, or content acquisition costs;

  • changes in costs related to technical provision, hosting, or distribution;

  • changes in customer service and other cost of sales, administrative, or overhead costs;

  • changes in taxes, levies, or other government-imposed charges;

  • inflation, including - but not limited to - in accordance with the Consumer Price Index applicable in your Market); or

  • investments in improving the Podimo Service, including adding new features or content.

Podimo will notify You of any price change or other material changes to Your Subscription Plan at least thirty (30) days in advance by email. The notice will specify the effective date and Your right to cancel.

Price changes will take effect at the start of the next subscription period following the notified date. If You do not accept the change, You may cancel Your subscription before the effective date. If You continue using the Podimo Service after the effective date, You will be deemed to have accepted the new price or plan, and authorize Podimo to charge Your payment method accordingly.

5.4. Communication and Contact

You are responsible for ensuring that Podimo has Your most up-to-date and accurate email address to allow Podimo to send important notices and messages, including notices about changes to the Podimo Terms, Service, or Subscription Plans. As appropriate and relevant notices and messages can also be communicated in the Podimo App, e.g. as a pop-up, banner in-app or push notification (if enabled).

6. PERSONAL DATA AND COOKIE POLICY

Your use of the Podimo Service is subject to Podimo’s Privacy Policy and Podimo’s Cookie Policy, and you expressly acknowledge that Podimo may process and use Your personal data in accordance herewith.

7. ACCESSIBILITY

Podimo is committed to providing an accessible experience for all users, in alignment with the requirements of the Accessibility Act (EU Directive 2019/882). Podimo’s goal is to ensure that the Podimo Service is inclusive and usable for individuals of all abilities. Below, Podimo outlines its efforts to meet these standards and enhance accessibility.

7.1. Service Overview

The Podimo Service offers access to podcast and audio content across mobile apps and over the web. Podimo is working to further enhance accessibility by developing and implementing features such as font scaling, screen reader compatibility, and hearing impairment support.

7.2. Accessibility Features

7.2.1. Scalable Text:

Text and titles in the Podimo Service are scalable, ensuring better readability. While much is in place, this remains an on-going focus and some buttons and components are undergoing additional improvements for full scalability. This scaling functionality has been implemented with some limitations on screen visibility. Podimo is actively working on improvements and planning further updates as part of its roadmap.

7.2.2. Screen Reader Compatibility:

Key features of the Podimo Service are navigable and listenable without visual input. However, certain elements, such as buttons, are being updated for better screen reader integration.

7.2.3. Hearing Impairment Support:

Podimo is planning for future updates to include AI-generated transcripts and captions for Podimo’s produced videos on the Podimo Service, enhancing accessibility for users with hearing impairments.

7.3. Compliance with Accessibility Requirements

In alignment with Annex 1, Sections 3 and 4 of the Accessibility Act, Podimo ensures:

  • Logical grouping and clear labeling of interface elements to support screen readers.

  • Decorative images are correctly marked to avoid unnecessary reading.

  • Titles and headings follow a clear hierarchy to facilitate navigation.

7.4. Ongoing Efforts

Accessibility is a continuous priority for Podimo. Podimo holds regular working group meetings to monitor compliance, adapt to new standards, and improve the Podimo Service. Podimo also integrates accessibility checks into its design, development, and QA processes.

8. RIGHT OF WITHDRAWAL, CANCELLATION AND SUSPENSION

8.1. Right of Withdrawal

You have a statutory right to withdraw within 14 days of signing up to the Podimo Service. If you access the Podimo Service within these 14 days You agree to immediate delivery of digital content and acknowledge that this waives Your 14-day statutory right of withdrawal.

You may exercise your right of withdrawal in accordance with the above by contacting Podimo - see contact information in section 16 below. You may choose to use the form below, but you are not obliged to do so.

8.2. Cancellation

If You purchased Your Subscription Plan directly from Podimo, You can cancel Your subscription in Your account settings on either the Podimo App or podimo.com and follow the instructions for cancellation. For more information on how to cancel your subscription please visit Podimo’s Support Center or e-mail to hello@podimo.com.

If You are on a trial via or have purchased Your Subscription Plan from a third-party, You must cancel through that third-party.

Your cancellation will be effective on the first day immediately following the end of the then current subscription period for which You have paid.

After cancellation is effective You can delete Your account in Your account settings or by emailing Podimo on hello@podimo.com and declare deletion of Your Podimo Account.

8.3. Suspension

You agree that Podimo may, in its sole discretion and without advance notice or liability, insofar as possible under applicable law or regulation, pause, restrict, suspend or terminate Your access to the Podimo Service or any part thereof and/or content thereon if Podimo believes You are using or have used the Podimo Service in violation of these Podimo Terms or applicable law or regulations or in any manner other than for their intended purpose.

Without limiting the foregoing, Podimo may upon reasonable notice to You, restrict or suspend Your access to Your Podimo Account for cause, such notice may be communicated electronically or in-app. Such cause includes: (i) request from law enforcement or other government authorities, (ii) unexpected technical issues or problems, or (iii) if Podimo reasonably believes that Your Podimo Account has been created fraudulently, Your Podimo Account has been accessed fraudulently, or anyone uses Your Podimo Account to commit fraud or for any purpose other than its intended purpose.

Upon cancellation of Your Podimo Account, whether terminated by Podimo or at Your request (other than cancellation of the subscription by You, in which case access to the Podimo Service will continue to the end of the billing period), You may lose the right to access streamed or downloaded content.

8.4. General

Sections 2, 3, 4, 5, 6, 8, 9, 10, 11, 12, 13, 16 herein, as well as any other sections of the Podimo Terms which, either expressly or by their nature, are intended to survive termination and/or cancellation, shall remain in effect after termination and/or cancellation.

9. ENTIRE AGREEMENT

With the exception of what is stated below in this section, these Podimo Terms and any terms and policies that they refer to constitute all of the terms and conditions agreed between You and Podimo and supersedes any prior agreements in relation to the subject matter of the Podimo Terms.

Please note that certain offers to access and use the Podimo Service may be governed by additional terms. This includes but is not limited to access and use of the Podimo Service as a result of a free trial, gift card or together with other products or services. When You are presented with such an offer You will also be presented with and asked to accept the applicable additional terms. To the extent that there is a conflict between these Podimo Terms and such additional terms, the additional terms shall prevail.

10. ASSIGNMENT

Podimo may assign and delegate any of its rights and obligations under the Podimo Terms in whole or in part.

11. INDEMNITY

You agree to indemnify and hold Podimo harmless from and against all damages, losses and expenses of any kind (including reasonable legal fees and costs) arising out of or related to (i) Your breach of the Podimo Terms, (ii) any activity You engage in on or through the Podimo Service that violates the rights of others, is unlawful, or violates these Podimo Terms, and (iii) Your violation of any law or the right of a third-party by use of the Podimo Service.

12. WARRANTIES AND CONFORMITY GUARANTEE

Some jurisdictions do not allow the exclusion of implied warranties or limitations on applicable statutory rights of consumers, so the exclusions and limitations in this section may not apply to You and will not affect Your statutory rights.

EU Conformity Guarantee
Pursuant to European consumer law, customers in Europe are entitled to a legal guarantee that the Podimo Service, throughout the duration of their Subscription Plan:

  • complies with the contract;
  • is fit for the purpose for which it is normally used;
  • is of satisfactory quality and performance.

Without limiting the foregoing this also means that Podimo’s liability under applicable product liability laws remains unaffected.

You access and use the Podimo Service at Your own risk. You accept and agree that the Podimo App, the Podimo Service and all its content is provided to you on an “as is” and “as available” basis.

Your listening experience may vary depending on Your device, internet connection, location or bandwidth. Podimo is not responsible for these matters or any internet or cellular data access charges.

Podimo is not responsible for any third-party software, services, websites, links or applications which are linked to, referenced in or integrated with the Podimo App and/or the Podimo Service.

13. LIMITATION OF LIABILITY

You accept and agree that in no event shall Podimo, its officers, shareholders, employees, agents, directors, subsidiaries, affiliates, successors, assigns, suppliers, or licensors be liable for personal injury or any incidental, special, indirect, or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption, or any other commercial damages or losses, arising out of or related to Your use of or inability to use the Podimo service, however caused, regardless of the theory of liability (contract, tort, or otherwise) and irrespective of if a party has been advised of the possibility of such damages, and even if a remedy fails of its essential purpose.

Nothing in these Podimo Terms shall exclude or limit Podimo’s liability for fraud, fraudulent misrepresentation, death or personal injury caused by Podimo’s negligence and, where required under applicable law, gross negligence.

This section applies to the fullest extent permitted by applicable law and You may have rights in Your jurisdiction which provides for remedies in addition to those set out above.

14. FEEDBACK AND UNSOLICITED IDEAS

If You provide feedback, ideas, or suggestions to Podimo in connection with the Podimo Service or content generally (“Feedback”), You acknowledge that the Feedback is not confidential and that Podimo has a right to use that Feedback without restriction and without payment to You.

You also acknowledge:

i. that Podimo does not generally accept unsolicited ideas or materials;

Ii. that Podimo may, from time to time, accept unsolicited ideas or materials for content on the Podimo Service; and

iii. that, in case Podimo accepts unsolicited ideas or materials, Podimo is under no obligation to review, retain or respond to such submissions. Additionally, if You submit ideas or materials via a dedicated pitch platform provided by Podimo, such submissions will be subject to the specific terms of submission as presented on that platform.

You further acknowledge that any content on the Podimo Service may be similar to ideas or materials You have submitted to Podimo. By submitting any ideas or materials, You waive any claims against Podimo and Podimo’s licensors in connection with the use, similarity, or alleged similarity of such ideas or materials to the content on the Podimo Service.

15. GOVERNING LAW AND JURISDICTION

The Podimo Terms, and all disputes or claims (“Disputes”) between You and Podimo relating to the Podimo Terms, the Podimo Service or the content provided via the Podimo Service, are governed by and construed exclusively in accordance with the laws of Denmark, subject to mandatory consumer protection laws in Your country of residence. The City Court of Copenhagen shall have jurisdiction of all Disputes, without prejudice to Your right to bring a claim in Your local courts in accordance with applicable consumer protection law. You may also use Your local out of court body for consumer dispute resolution (searchable on this link).
