The Court held that the Fourth Circuit had violated the “party presentation principle” by reversing and remanding “based on an issue the parties had not raised.” Rochelle talks with Markell about how the Margolin decision may create tension with the Court's previous ruling in Espinosa and how it may impact bankruptcy practice.
