Acerca de On Trial

Welcome to On Trial, a podcast dedicated to the art of trial. I’m your host, Christopher DeGennaro, a commercial litigation lawyer at Foley & Lardner in the firm’s New York office with a focus on trial practice. I have been fascinated by trials since I was in grade school, when both my parents served as prosecutors in suburban Philadelphia. On sick days from school, I went to work with my mother—often to court, where I sat in a back row and watched. Instantly, I was captivated by persuasive story-telling and trial advocacy. And ever since, I’ve been on a path to developing my own trial skills, starting out as a NYC prosecutor, clerking in a federal trial court, and now representing clients in high-stakes, commercial cases in trial courts across the country. This podcast explores all things related to the art of trial, including in particular, its artists—trial lawyers. Throughout the series, we’ll talk to trial lawyers from different areas of practice, hearing their stories and exploring the most interesting and important elements of trying cases.   DISCLAIMERThis podcast is provided for general informational purposes only and is intended as a general overview. The Art of Trial: On Trial with the Honorable Loretta A. Preska of the U.S. District Court for the Southern District of New York

In this episode of On Trial, host Christopher DeGennaro sits down with Senior U.S. District Judge Loretta A. Preska of the Southern District of New York. Appointed by President George H.W. Bush in 1992, Judge Preska has served as a trial judge in the nation’s premier federal trial court for more than 30 years. Judge Preska served as chief judge from 2009 to 2016, and took senior status in 2017. In addition to talking about her interesting path to the law, Judge Preska explains why trial is an art, and shares some interesting and instructive experiences from the bench. Judge Preska agrees with earlier guests on the most important part of trial, the opening statement, and that trial lawyers should convey absolute credibility and sincerity. Judge Preska also offers some invaluable advice to trial lawyers, especially young trial lawyers: engage with the jury, address the weaknesses in your case head on, always be formal in court, help the judge, be kind and courteous, and pick and choose your battles.
