Our take: We think that is the cleanest read of the testimony: the nonprofit mission argument gets a lot messier if the alternative on the table was control by Tesla. Independence is hard to claim when the proposed sanctuary is another Musk-controlled company.

Our take: That’s a fair two-things-can-be-true take. Musk’s own control bid does not automatically bless OpenAI’s later structure, but it does complicate the moral high ground in a lawsuit built around betrayal of the mission.
