Frank Palko shot and killed a police officer in Bridgeport, Connecticut in 1935. He went to trial, was convicted of Second Degree Murder and sentenced to life in prison. Then the State appealed, won and prosecuted Frank again. He was convicted of First Degree Murder and sentenced to death. How was the State able to do that?
