ABI Editor-at-Large Bill Rochelle discusses the Supreme Court's June 11 opinion in Keathley v. Buddy Ayres Construction with Prof. Robert Lawless of the University of Illinois College of Law. In determining whether an omission of a claim in the bankruptcy context was inadvertent or mistaken for purposes of the judicial estoppel doctrine, the Supreme Court held unanimously that courts should look to the totality of the circumstances surrounding the omission. Rochelle talks with Lawless, who joined an amicus brief on the case, about the background of the case, the decision and how courts are likely to proceed moving forward.
