Beskrivelse

A guilty plea to seven counts of murder, with an admission to an eighth, establishes the underlying facts for purposes of civil litigation. This look back, with defense attorney and former prosecutor Eric Faddis, examines the wrongful death lawsuit filed in the wake of Rex Heuermann's plea and what it means for his family's legal exposure. The suit, filed by the son of victim Valerie Mack, names Asa Ellerup and their daughter Victoria Heuermann as defendants, alleging the family profited from a documentary and demonstrated disregard for the victims. Counsel for Ellerup has characterized the claims as reckless. Faddis analyzes the legal theory — what a wrongful death action requires, how the guilty plea alters the evidentiary landscape in civil proceedings, and where the line falls between proximity to a convicted offender and actionable legal liability. He addresses whether the allegations as currently framed are likely to survive initial legal challenges. The segment also examines the plea agreement itself. Heuermann's attorney described the guilty plea as a "sense of relief" for his client — language that behavioral analysts read very differently than the general public might. Retired FBI Behavioral Analysis Chief Robin Dreeke assesses what that framing reveals about the defendant's psychological relationship to his crimes, and what the FBI cooperation requirement — part of the plea agreement — is designed to produce. Heuermann confirmed strangulation as the cause of death for each victim and is expected to be sentenced to three consecutive life terms plus an additional hundred years. We revisit where the matter stood at the time of our reporting. Did Lindsay Clancy's Own Medication Make Her Worse?

Lindsay Clancy called crisis lines, went to emergency rooms, checked herself into hospitals, and took thirteen different medications from five different providers over four months. Her defense argues every one of those interventions made her worse instead of better. Psychotherapist Shavaun Scott, author of Night Bird, sits down with Tony Brueski to examine the prescribing chain at the center of this case. The medications included benzodiazepines, antidepressants, an antipsychotic, and a sedative. Her husband Patrick told providers she was becoming a different person and begged them to stop. They increased the dose. The civil lawsuit filed by both Lindsay and Patrick describes providers who operated independently — no shared records, no coordinated treatment plan, no complete medication reconciliation. She was turned away from a suicide hotline because she had no specific plan. She waited three days in a psychiatric hospital before seeing a doctor. A nurse practitioner reportedly never returned a follow-up call from a referring facility. Shavaun addresses the question at the center of this segment — whether what happened to Lindsay is a catastrophic failure unique to her case or whether short appointments, revolving prescriptions, and fragmented provider networks are simply what postpartum mental health care looks like in this country. The answer determines whether the system bears responsibility for what happened to those three children. Tony Brueski and psychotherapist Shavaun Scott discuss the Lindsay Clancy case. Did Lindsay Clancy's Doctors Even Know What She Had?

Lindsay Clancy is standing trial in Plymouth, Massachusetts, for the deaths of her three young children. Her defense centers on postpartum psychosis. The prosecution says her actions that day were deliberate and planned. Psychotherapist Shavaun Scott, author of Night Bird, walks through the clinical reality with Tony Brueski. The conversation starts with what the public gets wrong — and most of the public gets it wrong. Baby blues affect the majority of new mothers and resolve on their own. Postpartum depression is a clinical mood disorder affecting roughly one in seven. Postpartum psychosis is a psychiatric emergency affecting one to two women per thousand births. These are not the same illness at different volumes. Psychosis involves a rupture from reality. Lindsay's providers allegedly charted intrusive thoughts when she was reporting a male voice commanding her to harm her children. Those two presentations carry completely different clinical weight. After the killings, a forensic evaluation diagnosed her with Bipolar I — a condition her providers had considered but never confirmed. Antidepressants prescribed for the wrong diagnosis can trigger the very psychosis the defense is now building its case around. Shavaun explains the spectrum, where the line between depression and psychosis falls, and why a woman in psychosis can build snowmen with her kids in the morning and be catastrophically disconnected from reality by that evening. Tony Brueski and psychotherapist Shavaun Scott discuss postpartum psychosis and the Lindsay Clancy case. Nolan Wells' Friends Face A Grand Jury They Can't Control

Everyone heard "grand jury" and filled in the rest themselves. Charges must be coming. Someone is about to be arrested. The system is finally moving. Except the Jackson County DA clarified the same day: referring a case to a grand jury is the default pathway when a death in the county cannot be readily explained. The referral itself does not mean law enforcement suspects foul play. This episode cuts through the noise and explains what a Mississippi grand jury actually does. Not the social media interpretation. The real one — where a panel of citizens convened by a circuit court judge reviews evidence in a sealed proceeding and decides whether probable cause exists to bring formal charges. Probable cause is the lowest bar in the system. Clearing it does not produce a guilty verdict. It produces a formal charge — an indictment — and the case then moves to a trial with an entirely different jury and a much higher standard of proof. What makes the grand jury significant in this case is a tool most observers skip past: the authority to subpoena witnesses. Every person summoned enters that sealed room individually. They swear an oath. Their lawyer stays outside. And the questions they face carry legal consequences if they lie. In a case where the group that went to Horn Island with Nolan has offered stories that directly contradict a separate witness, that forced testimony — solo, sworn, behind closed doors — could produce clarity that no press conference ever will. Autopsy results from two separate examinations remain outstanding. The agreed-upon joint review of Nolan's cellphone data has not occurred. Witness accounts remain unreconciled. Whether the grand jury has what it needs to act depends on how much of that evidence is assembled before the case lands on their table. Does Lindsay Clancy's Own Job Prove She Knew?

Lindsay Clancy murder trial — prosecutors want a jury to look at her résumé and conclude she understood exactly what she was doing. She was a labor and delivery nurse. That is the fact the Commonwealth wants to sit in front of the jury while it argues deliberate premeditation. A woman who worked in maternal health knew the language, knew the screening tools, and knew how to present. Kevin Reddington's response is that she used all of that knowledge to ask for help, repeatedly and specifically, and the system handed her prescriptions and a discharge paper instead. This is the full three-part conversation between Tony Brueski and criminal defense trial attorney Bob Motta covering the entire case. The first segment goes through the prosecution's evidence — the timing of a takeout order, an errand, and a note on her phone that a prosecutor read out loud in open court. The second examines what is left of the defense after the pretrial rulings, including the decision to keep women who have survived postpartum psychosis off the stand, and the roughly thirteen psychiatric medications her attorney says she was prescribed over about four months. The third takes on the justice question directly: what a verdict is supposed to accomplish when both outcomes end in confinement, and why the people who wrote those prescriptions will only ever face a civil claim. Patrick Clancy buried three children, asked the world to forgive his wife, sued her doctors, and will take the witness stand. Cora was five. Dawson was three. Callan was eight months old. This trial is going to make a lot of people pick a side they did not expect to pick. Did Prosecutors Rig Lindsay Clancy's Trial?

People searching the Lindsay Clancy trial want to know about postpartum psychosis and the insanity defense. What almost nobody is covering is the pattern of prosecution moves that shaped this trial before it ever started. Between July 9 and July 20, the Commonwealth made three deliberate plays. Strangulation charges dropped to eliminate a jury's middle ground between life without parole and a psychiatric hospital. Lay witnesses who survived postpartum psychosis blocked from testifying about what the illness feels like. Defense expert witnesses challenged on the first morning of jury selection before a single juror sat down. Tony explains why the pattern matters more than any individual ruling. Massachusetts law puts the burden on prosecutors to prove criminal responsibility once insanity evidence is introduced. That means the prosecution needs to control the information the jury receives, and every voice that gets removed from the room is one fewer obstacle to their proof. The episode also covers what Reddington asked for and didn't get. He wanted the judge to tell jurors about the reversed burden before opening statements. Prosecutors objected. The judge sided with the prosecution. So the jury enters not knowing who has to prove what — and the Commonwealth gets to build its case first. Plus: what the defense has left after the bench was stripped, the eighteen-juror panel, and why the version of her mind the jury carries into deliberation depends on who they never heard from.
