According to source accounts surrounding the lawsuit, Prince Andrew was caught flat-footed by Virginia Roberts Giuffre’s decision to take him into a U.S. federal court rather than simply continue the fight through interviews, public statements, and media pressure. The lawsuit, filed in August 2021 in the Southern District of New York, accused Andrew of sexual assault and intentional infliction of emotional distress tied to Giuffre’s allegation that Jeffrey Epstein and Ghislaine Maxwell trafficked her to him when she was 17. Andrew denied the allegations, but the filing changed the entire battlefield: this was no longer just a reputational crisis or another ugly Epstein headline. It became a live civil case with discovery, depositions, court deadlines, service fights, and the possibility that Andrew would be forced to answer questions under oath. The “blindsided” part matters because Andrew and his camp appeared to believe they still had legal escape routes, especially the 2009 settlement between Giuffre and Epstein, which they argued should shield him from liability. But Judge Lewis Kaplan rejected the attempt to dismiss the case in January 2022, finding that the settlement language was not clear enough to simply wipe away Giuffre’s claim against Andrew at that stage. That ruling left Andrew exposed to the very thing he seemed desperate to avoid: a drawn-out American legal fight with sworn testimony, evidence demands, and global headlines hanging over the monarchy.
