Episode 115: SCOTUS did not rule on Birthright Citizenship? So what did it do?

SCOTUS just dropped a new Birthright Citizenship case at the end of June 2025, but what did it really decide? We all expected SCOTUS to rule on the real issue - whether the term "birthright citizenship," stemming from the 14th Amendment of the United States Constitution and from the Nationality Act of 1940 really means that anyone at all who is born within the physical borders of the United States is a citizen of the United States. However, the Supreme Court surprised us all and declined to rule on this issue. Although this Supreme Court decision is considered by most to be a win for Trump and the Trump Administration, it is only a limited decision, and it has nothing to do with the question of birthright citizenship. Instead, it only has to do with whether single federal District Court Judges may issue nationwide injunctions that would apply to all courts and to the entire Executive and Legislative Branches of the Government. In Trump v. CASA, Inc., 606 U.S. ____ (June 27, 2025), Supreme Court Justice Amy Coney Barrett wrote the Majority Opinion for the Supreme Court, holding that single federal District Courts cannot issue nationwide injunctions. SCOTUS then sent the case back to the lower courts to have them determine the question of birthright citizenship and come back up to the Supreme Court through regular review processes.
