Physician Contract Length, Renewal, and When to Re-Negotiate

Physicians might expect their employment contracts to last around a couple years before they can choose to renew, with options to terminate the agreement beforehand if necessary. In reality, contract length, renewal terms, and termination language are not always so straightforward. The term length of a contract and other details surrounding it are important to review and even negotiate prior to signing. Sometimes, employers fail to include any specific contract end date or termination terms at all, in which case a physician will absolutely need to have those details added. Even when the basic terms are present, many contracts auto-renew, and they may only have a term length of one year after the initial length of two years. Understanding these intervals, how much notice you must provide to terminate a contract, and when are the best times to re-negotiate helps physicians maintain control of their careers. Non-competes have become more of a hot topic than ever before, following the FTC’s recent attempt to ban such clauses nationwide. This is especially true for physicians and others in the healthcare sector, where employers frequently leverage non-compete clauses against employees. While a nationwide ban never went into effect, some states have restricted or banned non-competes on their own. When faced with an employment contract that includes a non-compete, a physician must consider many factors before signing.
